Surety products are on the rise in Latin America, with some countries like Mexico bringing in specific legislation to govern them. In this talk we will look at how surety works, key issues to look out for and how they operate amongst other similar products.

The focus will be on surety in construction projects and we will explore some of the other issues associated with construction in Latin America, with reference to recent experiences.

Topic to be presented by Anna Weiss

AnnaAnna is the Deputy Head of Kennedys Americas and manages the business operations of the Miami office. The office has two business units: as the ‘gateway’ to Latin America and the Caribbean, and also covering US law. In addition to her managerial position, Anna is the Head of Construction for Latin America and the Caribbean.

Originally from the UK, Anna joined Kennedys in early 2013 on relocating to the United States. She commenced her legal career with a leading law firm in London in 2003, qualifying as a solicitor in England and Wales two years later. She then specialised as a construction and engineering lawyer.

Anna’s legal career has also taken her in-house as she was seconded to AEG Europe during the development of the Millennium Dome into The O2, which was subsequently named the most successful entertainment venue in the world. She gained first-hand working knowledge of multiple high-value projects from origination through to completion, while navigating a range of lifecycle challenges and technical complexities.

Her role extended beyond construction and insurance law into general contract and commercial law, and Anna also acted for the London river transport company Thames Clippers. Having served as in-house counsel, Anna is equally familiar with handling disputes from the perspective of a client.

As Head of Construction for Latin America and the Caribbean, Anna is the key contact on construction and engineering risks, professional indemnity, surety, and operational policies in LATAM and the Caribbean. She is also the key contact on all legal matters throughout the Caribbean and has worked across the LATAM region on most types of insurance claims, such as property, casualty and public liability.

She also regularly speaks at industry events on matters concerning the region.

Anna works in English, Spanish, and French.

Work highlights

  • Acting for a large international reinsurer on an uncompleted roadway project in Bolivia where a surety bond was called.
  • Acting for a large international reinsurer on a possible defective design issue under an Engineering All Risk/Operational policy in Brazil involving a billion US dollar dam project.
  • Acting for a large international reinsurer on a tunnel collapse claim in Chile under a Construction All Risk policy.
  • Acting for various reinsurers following storm/hurricane damage in LATAM and the Caribbean.

All of the above relate to claims over US$10 million.
