Next Miami seminar. Environmental liability laws: An emerging concern for businesses in Latin America

Polluter pay regulations that hold operators responsible for damages to the environment are well established in the USA and, more recently, in the EU.

There have been recent important developments in Latin America that are changing the environmental liability landscape, including development and implementation of an environmental court system in Chile (under law 20600 in 2012 creating Tribunales Ambientales) and recently enacted legislation in Mexico on environmental liability modeled after the EU Liability Directive and Spanish Law.

In this seminar we will discuss some key technical “lessons learned” drawing upon environmental cleanup and environmental liabilities under natural resource damages regulations of the USA and EU and will identify issues and concerns that may arise as Latin American countries adopt similar liability regimes.

Pieter-Booth

Mr. Pieter Booth is a Principal in Exponent’s EcoSciences practice with 28 years of experience as an environmental scientist and program manager specializing in ecotoxicology and risk assessment, natural resource damage assessment (NRDA), and restoration of natural systems.  He has conducted environmental audits in support of insurers regarding emergency response and cleanup and environmental restoration in Peru and Ecuador and has active projects in Chile, Brazil, Guyana, Peru, and Jamaica.

Nicholas-Gard

Dr. Nicholas Gard  is a Managing Scientist in Exponent’s Ecological and Biological Sciences practice and is based in Bellevue, Washington. Dr. Gard has more than 25 years of experience in ecology, environmental toxicology, and wildlife biology. He has managed or conducted natural resource damage assessments (NRDA), ecological risk assessments (ERA), site reconnaissance visits, environmental impact assessments, and habitat evaluations in a variety of terrestrial, wetland, estuarine, and marine ecosystems both in the United States and internationally.
